Chapter-13~~element56CHAPTER 13 BANKRUPTCY is known as court-supervised “reorganization” and is governed by 11 U.S.C. § 1301 et seq.  A filer for Chapter 13 receives the extensive protections from creditors imposed by the Automatic Stay to providing breathing room while a Chapter 13 Plan is proposed and executed.  The filer’s Plan is powerful and can cause mortgage loans to be reinstated, vehicle loans to be modified, loan arrears to be cured and certain liens to be stripped from the filer’s property.  Chapter 13 can be particularly useful to filers who are engaged in small business.
